DR. EVIL SENTENCING--NEED SUPPORT

Not sure if this has been posted, but @skd_ just posted on twitter that the judge in the Dr. Evil Mandeville Mow-Down case needs letters to sentence the Good Dr.

You know the defense will have a slew of letters attempting to show what a wonderful and compassionate person he has been in his many years as an ER doc, but I'm sure some cyclists have some different opinions of someone convicted of 7 criminal charges.

Thanks for posting this. It is important that those who can find the time and the inclination please write a letter expressing your disgust with this crime. Also detail your experiences as a bicyclists with either an injury or a close call, and that a message must be sent out to those who feel that they can injure bicyclists with impunity. A lengthy prison term will make that message loud and clear. Hit a bicyclists...go to jail.

Just talked with Mary Stone. She's got lotsa letters, but the more the better. She'll include all letters she receives in her sentencing memo to the judge to support the deterrence notion: hit a bicyclist, go to jail, as it was aptly put.

She stressed: the best letters start out with who you are: "I'm a regular cyclist here in LA and fear . . . " or "I'm a nurse and see all to many cycling accidents . . ."

Dear District Attorney Stone and Judge Millington,

I am a regular bicycle commuter in Los Angeles, by choice. I am 54 years old and have been commuting to work by bike for several years, and have logged well over 4,000 miles doing so. I own an automobile and drive it distances I cannot travel by bike.

Riding my bike I once had to deal with an apparently enraged driver who brandished his automobile, a purple PT Cruiser, in an unmistakably deliberate, threatening and potentially injurious manner unmistakabely directed toward me.

I was making a right turn on my bike onto Owensmouth Ave Northbound in Warner Center, and the driver was signaling to make a left turn also to Owensmouth Ave Northbound, from the opposing direction of traffic. I had signaled with my left arm the proper right turn signal, but was carrying a shipping tube in that hand and raised the tube as part of my right-turn arm signal.

I surmise the driver of the car mistakenly took my turn signal with shipping tube as an affront. Once we both completed our turns we were alongside one another in the right hand Northbound lane of Owensmouth, where this Avenue has two Northbound lanes. For safety, the driver could have taken the other lane. But in the right lane, the driver kept his speed at mine, which soon became too slow for a car in traffic. Then he jerked his car into, then less-so out of, my pathway, keeping his car's pathway angled across mine, then jerked his car toward me *again*. The second time was a cumulatively deeper intrusion across my original pathway than the first, windows up the whole time. This was terrifying; I had to turn toward the curb multiple times to avoid a collision.

There is no question in my mind that this driver's actions were maliciously intentional, given their controlled, repeated, aggressive and dangerous nature, directed at me.

I never saw the driver's face nor the driver's license plate, so I did not report the incident. Fortunately, the incident has not repeated itself.

But I can say, given your case at hand and my experience, that there is more than one driver in our city who does not stop at using their automobile to aggressively, physically, repeatedly and intentionally threaten cyclists with serious bodily injury.

Please consider these facts and observations when making your sentencing decision.

Dear Hon. Millington:

I am an attorney, a father of two young boys (both of whom regularly bike on the streets of Los Angeles), and a daily bike commuter from Los Feliz to my office in downtown Los Angeles.

I read with not only sadness—but thoughts concerning a fear for my own life as a vulnerable cyclist on city streets—the case of Dr. Thompson, his reprehensible actions, and the injuries that he so unnecessarily inflicted on the cyclists in Mandeville Canyon.

I, too, have been the victim of unnecessary harassment and intentionally malicious driver behavior—just for cycling on our city streets. Frankly I’m lucky to still be here to write this letter, and luckily my injuries were significantly less severe those inflicted upon the victims by Dr. Thompson.

But unfortunately, many drivers seem to be unaware of the consequences of taking out road rage on cyclists—just for cycling on our city streets. And unfortunately, it seems many of our own LAPD are either unaware or unwilling to treat such criminal behavior for what it is.

I can’t help but think over and over again on every ride what if I were the victim of a similar act of intentional violence? What would my two boys be feeling if I were not to show up for dinner one night? What type of worry would my wife have to endure upon receiving that call, after hours of hand wringing, from an emergency room informing that her husband’s skull had been propelled through the rear window of a driver that “wanted to teach him a lesson.” For cycling?

A strong sentence will reverberate loudly to our fellow motor vehicle driving community that intentionally harmful or vindictive behavior will not be tolerated--and will be severely punished.

A strong sentence will send a message to our LAPD, whose enforcement of crimes such as these is historically lax, that if a driver intentionally hits a cyclist, he/she will be prosecuted and go to jail.

I am compelled to write this letter because I feel that Your Honor has a chance to chip away at the severely outdated notions held by drivers, law enforcement, and possibly our elected officials that keep many off their bikes and in fear of their lives. I plead with my wife and have to regularly convince her (and scores of other parents with whom I regularly see) that it’s ok for me to bike with my sons on city streets. She’s afraid we’ll all die. That is so wrong. True, accidents happen, but intentional infliction of grave bodily harm of the kind doled out by Dr. Thompson simply never should. But when it does, the consequences must be dire.

This defendant must be taken off our streets, this defendant must have his driver’s license revoked, this defendant should be forced to fund an insurance trust that would pay for the medical bills and expenses of cyclists for those that have no insurance or ability to pay for their cycling injuries.

Thank you for your consideration.

My guess is that twitter will be the best source of info as the day rolls on. DJWheels, who is there, has posted a few updates (nothing critical as of yet), and will likely be throwing out more. Check @LosAngelesCM, @SoapBoxLA, @dudeonabike, @skd_, and I'm sure there will be others, for re-posts of info.
