Legal Advice!
Thread started by BoneCrush at 04.25.11 - 5:17 pm

Yesterday afternoon I was hit pretty bad by a big ass truck, we exchanged info. I contacted a lawyer, but now they are telling me there is nothing I can do about it because supposedly I wasn't suppose to be on the street in the first place. My bike is fucked up, and this guy won't want to buy me a new one. What is there to do?

Huh...doesn't make sense why they would say that.

What city did this happen? What streets exactly?

Sorry to hear about your accident.

Here's what LA Bike Blog Says:
Riding on the sidewalk in the City is legal as long as you aren’t being dangerous. If you feel you must ride on the sidewalk, please be extra careful when navigating intersections, driveways, and alleyways. Bikeways, as always, encourages riders to take their rightful place in the street. LAMC Sec. 56.15 lays it out for you:

No person shall ride, operate or use a bicycle, unicycle, skateboard, cart, wagon, wheelchair, rollerskates, or any other device moved exclusively by human power, on a sidewalk, bikeway or boardwalk in a willful or wanton disregard for the safety of persons or property.

dude you need to call them up and tell them they need to pay for your bike and personal injury (you hurt your neck/back and had to miss a few days of work remember?)

unless there are other circumstances you didn't share, theres no reason they shouldn't reimburse you.

bicycles are allowed use of the full lane, jefferson is no exception, you had every right to be on that road and the driver of that truck and this insurance company need to know this and pay you for their fuck up.

WTF? If that's what a lawyer told you, neither you nor any other cyclist should have any further dealings with him/her. If that's what an insurance company told you, that's obviously BS. More details would be helpful, but don't put them here where they might come back and bite you in the ass.

Did you get the driver's insurance information? Any witnesses? Don't repair your bike (yet). Write down everything you recall--and do it only after your attorney tells you to do it. So tell Danny to instruct you to do it if he hasn't already, or call me, and I'll tell you to do it. 213.623.7515.

Man-o -- I miss read that so poorly. I thought you were on the sidewalk. My eyes read what they want sometimes. Yes, bikes are allowed full use of the road!
