An apparent road rage incident between two motorists in downtown Los Angeles left a bicyclist dead Tuesday night.

A 62-year-old man was killed after being hit by one of the cars while riding his bike at 8th and Francisco streets, said Los Angeles police Officer Karen Rayner. His name has not been released.

The crash was still under investigation, but Rayner said initial reports were that the driver of a Chevrolet Avalanche, a 37-year-old man, had been detained for questioning by police. The driver of a Kia compact car, a 23-year-old woman, remained on the scene but had not been detained, she said.

Rayner said the drivers apparently had some dispute while heading north on Figueroa Street. They turned left on 8th Street, and near Francisco Street, the driver of the Avalanche tried to pass the Kia on the right.

While doing so, he allegedly struck the bicyclist, Rayner said.

Do they have the fallen rider's name yet? They said his age, but not his identity.

I'd like that info before I put it up at the location. (8th and 110 exit , right?)

I was thinking of maybe picking up the one you have a trying to get his name and go out chain it up within 48hrs or sooner of his untimely passing

What do u say? Pick yours up or should i build one at the bike oven.

How in the hell do you make a dangerous and illegal maneuver, resulting in a death, and get released? They MAY file charges at a later date? Gimme a break.
LAPD's apparent hostile attitude toward cyclists enrages me.

I hope they don't decide it was the rider's fault for "being in the roadway".

Manslaughter would not be the appropriate charge as it applies if it is committed in the heat of passion or quarrel. Common examples are a husband walking in on his wife with another man and killing him/her/them. Another example would be seeing your kid hit by a drunk driver and then running over and killing the driver.

This may be vehicular manslaughter if it is determined that the driver acted with gross negligence. The driver can also be charged with murder if his actions were so wanton and reckless that malice can be implied. An example of this would be someone driving full speed on the sidewalk. Even if the driver does not intend to kill anyone, a reasonable person would know that someone could get killed by behaving with such extreme recklessness.

Were his actions not done in the "heat of passion or quarrel"? I mean they were arguing and he pulled some sketchy shit because of it. Why does it matter that a third party was killed as opposed to the other driver?

Hi monovsstereo,

I am not defending the law just letting folks know what we have to work with.

It's different towards a third party because there is no intent directed towards them...thus it would be involuntary manslaughter...however the penal code specifically states that if the person is in a vehicle an involuntary manslaughter charge does not apply and must be looked at within the context of vehicular manslaughter

This is the world we live in. Killing human beings is acceptable as long as you fit into the right loophole, one of which is that killing bicyclists with your motor vehicle is often not punishable according to the letter of the law; and even if it is, the jury may simply decide that the convenience of the motor vehicle trumps the security of human life and give the case away to the defendant.

That man in the Avalanche needed to settle his petty score with the woman in the Kia, and the only way he could think to do that was by passing her recklessly to assert his superiority.

This is how people solve problems in our society. It is the American way. Yeah I know it's sad and it sucks and we want to change it, but for the moment it is just the way it is. It makes me so sad and angry. It makes me wonder when my number will be up. It makes no difference whatsoever how safely you ride if a murderer is going to just mow you down in a moment of uncontrollable rage.

Pathetically, the police and the DA are sympathetic to motorists and largely unconcerned with public safety. They are concerned with the letter of the law, regardless of its adequacy. Not with justice, not with public safety.

When you mount up you are taking a risk. Drivers won't help you; the police won't help you; the courts won't help you. Unfortunately, this is how our society is structured. It is not right or fair, but it is the world we live in. I may be killed and my loved ones will have no recourse whatsoever. I think about it every time I ride.

Hello All,

Here is a brief synopsis of what occurred:

The driver of the Kia made a left turn from Francisco to west bound 8th Street. The driver of the avalanche did likewise and was in the number 4 lane of traffic. The cyclist was changing lanes from the onramp lane (right hand turn lane) into the # 4 lane. When the driver of the Avalanche struck the cyclist he stopped and checked on the cyclist (in complaince with the law....no hit and run).

The investigation will be brought to the CA/DA for consideration.

The following strategies have already been put into place to address this issue:

· Central Traffic Division Community Traffic Safety Unit officers are scheduling to conduct “Bicycle Safety” presentations at local schools and community meetings within the next two weeks.

· Central Traffic Division Detectives are scheduling a press conference with Media Relations next week on July 26, 2011, to make the public aware of specific issues raised by recent vehicle vs. bicycle incidents and to provide general bicycle safety recommendations.

· Central Traffic Division Watch Commanders are being instructed to include bicycle-involved traffic collisions as a topic of discussion at every Roll Call for the next two weeks. sion has taken the following actions with regard to this collision:

Just to put things in perspective, the driver of the Avalanche would be in jail if this would have happened in the Netherlands or Denmark. His face would be all over local newspapers, and he would be ostracized for years to come.

All these reactive measures are all well and good but you'd be a fool to think for one moment that a person on a bike is a second class citizen and "measures" or any sort of action take by the authorities is just a knee-jerk finger in the dyke sort of thing.

We are on our own.

We will always be on our own.

You have to look to one's self for your safety.

I just assume everyone is trying to kill me, and thus I get around fine.

Sorry, I'm just pissed and venting my anger.

This sent a chill up my spine. I think of all those people killed and the very little to none being done to help their families, or the current epidemic, everytime I hop on my bike. Fuck.

Since we know all this and people driving cars don't pay attention, why don't cyclists make an effort to be more visible?

Everyone from construction workers to meter maids wears those reflective neon vests that cost only $4.99. Why don't we all wear them?

I can't tell you how many cyclists I see wearing all black riding at night.

When does the investigation of the Kia driver become public? I'd like to read it. I'd like to see if there was any act of rage going on with the Avalanche driver or not. I bet there was. What the LAPD would play off as just a "friendly disagreement". Damn I hope this dude can do some haunting to his perpetrators. I hope he'll have a little left for the department too!

This just gets chalked up as another one against the LAPD if this is the end.
