You can also get them at the Santa Monica City Hall from 9-4 everyday.
A bike license is good throughout the State.

my story goes like this...


I called up the number based on this thread to make sure that the hours were correct. the person I spoke to said the hours were 8AM to 5pm and I asked him if he could double check that because I'm getting info its 10am to 8pm. he said he was sure.... it was already 6pm. Well, I decided the info on here was correct and went down there anyway. I get to the station and indeed the hours ARE 10am to 8pm. Great! It was 7pm one problem, the person who does the bike licenses left early.... "left early? can someone else help out then?" "I wish we could but they don't want us to do it because it causes extra work." I was pretty irritated needless to say so I ask to see a supervisor... The lady there was actually really nice to me and even said under her breath how ridiculous it was that she wasnt allowed to do it... so this flat top plain clothes guy walks by and tells me I have to come back because the person who does the bike licenses is pregnant and had to leave early and no one else can do it........ I was supposed to be sympathetic because the person was pregnant and the flat top guy was trying to make me look like a jerk for pressing the issue.

I tell flat top guy, are you serious? no one here can take care of my bike license? "she's pregnant what can we do?" I said this is the city of los angeles not some mom and pop operation... if someone leaves sick then another person should be available to take care of business. let me speak to your superior. flat top was all kinds of cranky but he went and got me the commanding officer. I told him I'm not trying to be a jerk but someone should be able to handle getting me my bike license. I came all the way down here as per your already limited terms for a ticket that already feels like police harassment... the guy was very nice about it and he told flat top to hook me up which he did.... so I waited till the form was filled and everything done... then I pulled out a $50. ha. flat top had change though. I think he realized he was being a dick so he then turned into helpful guy which I appreciated. he asked if all my friends came down too. apparently a bunch of people have been registering.

i want to tell you guyz something, there is only one (1) type of bike license now, the city of angels repealed that old local law, and the only requirement is for the state of california sticker,
also that 'renewal sticker' is for the old law with in the same city only.

CVC bike license never expires, they are not a permit to drive a bike, they are a way to recover your bike, go to any police dept, and they have 100,200, 400 bikes in the sally-port. (you have to be in the back seat of the cop car to see them)

if you put that addittional sticker on your bike, and it expires, then they can make you renew, (the citys all want to put their grubby fingers in the mix, and make you keep repaying) think money scam.

nice job roadblock. the watch commander told me they have an influx of registrants. thank you for getting that ticket, you saved a lot of us, again thanks.

If anybody's curious, the sticker is about 1.5" square, bright blue, quite ugly, and once applied to your bike will not ever come off without seriously damaging the paint job.

The Santa Monica license is the same one LA uses. It just was easier to get in Santa Monica because they do it everyday, even though I live in LA.

I think mine cost $2.00 in Santa Monica too. I got it a couple of months ago.

Bicycle Licenses Required (LAMC 26.01) Requires a bicycle license for all bicycles purchased and ridden in the City of Los Angeles. Available from a bicycle dealer when a bicycle is purchased in the City of Los Angeles by the bicycle retailer or from local Los Angeles Police Stations.

If we all go get licenses, some of us think that we are "sticking it to them".

ON SUBJECT: Bike Licenses. You found it VioletMoodSwings.

Lately the cops have been harassing us, and threatening to give us tickets for not having Bicycle Licenses. It's a new tactic they are using to disperse our rides.

It's an archaic law, which was intended to prevent theft by cataloging bicycles with their owners. It's a $10 fix-it ticket, for a $3 license, which probably costs taxpayers about $30 in personnel wages and stickers. It's stupid. Some bikes don't have serial numbers, and the license stickers can be removed. Some people think feel better about getting the licenses. Some people feel that they would be 'sticking it to the man' if we all swarmed up to the police stations and all got licenses.

I'm going to stick it to the man by NOT getting one, or making my own.

Anyone here a Notary Public?

the stickers cant really be removed from the frame once they are stuck on. if you peel the corners away the middle part with the actual number stays while the CALIFORNIA and BIKE LICENSE part is gone. i mean, i guess you could then use a dremel or a sander or something to get rid of the rest of it, but youll ruin the paintjob in the process.

When you go to court with the ticket, (judging by past experiences) you most likely have the charge dismiss, by correcting the violation. I don't think they will hold you to the $160 unless you don't get the license. Of course you will have to pay the law enforcement sign off fee.

You may or may not have to pay a dismissal fee. Now if the idea of having to pay for something that you are not guilty of, doesn't make you hot under the collar, you probably aren't breathing

i keep my license in my wallet since i always have it on me.....and i made a xerox of it and made a spoke card out of it. i'm not worried about it getting stolen....just one less thing the cops can hassle me for. if it does get stolen i have the license number and the serial number is on file with the police.

Bail is like a retainer. It's money that is held by the "state" as ransom, to make sure you come in to court. That's all it is. It's not a fine, it's collateral, and they use it to cover the costs of the fine if you "bail". The complete term is Bail Bond. If you can't pay the bail, you usually sit in jail, until your court date.

at least that's MY understanding of Bail...

Roadblock, if you have time, waste theirs and fight that shit.

When was the old bike licensing law repealed? How'd you find that out?

What specific code violation were you cited for?

26.01 makes no mention of a fine, but Cal. Vehicle Code - Division 16.7 - Section 39002 does state that it is an Infraction to operate an unlicensed bicycle and Section 39011 sets the maximum fine at $10.

Hopefully that helps.

Seriously though, the bike registration is being misused to punish cyclists. We have some examples of this happening, and we should really push for an end to compulsory licensing. It's being used to harass cyclists who are not committing any other infraction, and totally goes against the spirit (if not the letter) of the law. Tell me, has anyone ever gotten a stolen bike back because it was registered?

I wrote a nice letter to my city council representative, Tom LaBonge. I'm asking for an explanation of the compulsory bicycle registration, if the LAPD's actions are condoned, and if they'd consider repealing mandatory registration. I invite you all to start poking around and asking questions of your public servants. Don't complain to the police, complain to their bosses.

I went down to the same spot and got my second bike registered. This time there was a whole bunch of commotion going on.... and everyone was arguing and on edge. A loudmouth crackhead, a shop owner claiming that he received a counterfeit traveller's cheque, some dude who was filing paperwork because he was assaulted.... it was a zoo.... once again they told me I had to come back, and I was more sympathetic this time but said I would wait my turn....

I saw two of the officers who gave me a ticket there... so I would suggest that everyone go to the station and get your bike license. Wait patiently and don't let them turn you away. In a way I can see why cops are dicks. They are understaffed and their station is in disrepair.... but this new law was obviously put into effect so as to give cops a "gotcha" to us whilst on group rides. So. Make it a burden when they pull that bs card. Innundate them with bike license paperwork be patient and respectful but don't let off. This is the city's stupid law, and its the cop's fault for pulling such a wienery card. Paperwork.

Has nobody thought of using the famous "Zergling Rush" on the LAPD at their station on a given time and date?

With proper coordination, video cameras, bloggers (Damien from Streetsblog LA and Steve Hymon from Bottleneck Blog), etc. this could be quite a little ruckus we could cause in the local media.

This law is dumb. If it were properly enforced, maybe it would help fund more bike projects, etc. That is a long shot in this city. Since it will not be properly enforced and implemented, it should be repealed. Making every toddler on a bike into a criminal is the wrong way to go.

So, name the date and time, we all show up and form one huge line demanding bike licenses or a repeal of this law. A minor media stunt to get conversations about this started.

How about next Monday, September 29th? I take care of my infant daughter on Monday. I'll haul the bakfiets down to skid row and change diapers in the waiting room while waiting to register my bakfiets. That will mean I have only 6 more bikes to license (not counting the hundreds in my bike shop still left to do). Anyone want to join in? I'm sure it will be an all-day event - with people coming and going.

I'm not sure if this is a good idea or not (the pros & cons have been discussed earlier), but the posted hours for bike licensing are Tuesdays and Thursdays from 10am-8pm. Which still doesn't seem to guarantee that there will actually be anyone there, but just sayin'.

The whole program is obviously a joke on so many levels, but from a purely practical standpoint, making the Central Station (in the heart of skid row) the only place you can do this, limited hours, and having one pregnant woman handling the paperwork makes it a completely Kafkaesque experience and dooms it to failure. Nothing against the woman or her pregnancy; she was polite, efficient and actually very human, but what going to happen when she goes on maternity leave?

I was at the station during what I take to be a relatively peaceful time, but I actually started to have some sympathy for the people that worked there.

Oh, and by the way, bring exact change if you can.

Spoke to Officer Stilkey and the forms are kept in the watch commanders office locked. they have 4 now and i told him he should restock since cyclists are being cited for not being licensed.

i'd advise calling once a day to see if they have received their shipment of new license forms.

IMHO the point is this.... the cops who ticketed us work out of that station. I saw alvarez, the main culprit, and his baldheaded sidekick there. They were being dicks that night first by driving irradically and dangerously, then by ticketing myself and some others because we wouldn't leave from the sidewalk we were stopped (by them) at. They have waaaaaaaaay better thing they could have been doing with their time in that district.
We were literally riding legal except for 26.01 which I suspect was written into law to give cops the upper hand to disperse our rides. Therefore I have absolutely no remorse for their whole crew. The same principal that gave them no remorse for pulling all of us over because one of us ran a light.

So now its time to pay the piper little coppers. Mention that the tickets were given out by Alvarez. Everyone go down there and get your licenses. One because it actually will prevent silly petty cops from ticketing you in the future and secondly to cause a major headache directly to the petty small minded crew of cops who were very dangerous in the way they pulled us over twice before they got people on a petty technicality. I saw everyone and we really were riding well behaved and mostly legal. There was no reason for them to get agro like they did and they didn't have a right to detain us and then disperse us without our comrade.

I have one more bike to register. I'm down to coordinate for thursday and have small groups go in waves. Specifially Mention Alvarez, the officer who demanded that we get bike licenses his badge number is 11823.

DO NOT LET THEM TURN YOU AWAY.

Sure, I do feel for these guys because they are understaffed and they are dealing with the worst of society.... but... they asked for it by fucking with people who really weren't doing anything wrong. Anyone there can write the bike licenses don't accept anything less.

How about we schedule a ride for thursday. Start at 6pm at sunset/vermont redline station? I will host if there is interest.

This is a chance to reward the petty behaviour with some civil obedience.

Lemme know I have one more bike.... in fact... I will go to the bike kitchen or bike oven and start registering as many as I can. $160... fuck that.

That was the point I used with them to the commanding officer when they first tried to turn me away. First of all be VERY calm and VERY respectful but be firm. You aren't leaving without a license. This is the city of los angeles and every one of them has the ability to write the bike license. Its a matter of getting the little beige box, filling out a 4x5 inch form, writing down your serial number (you don't need a serial number if there isn't one on the bike) and paying $3. Bring exact change so there is absolutely no excuse.

What Mom rida said. Get them to fill out a voucher for use in case you get pulled over. Also, fill out a complaint form if they absolutely refuse.
I assume that will still require them to fill out paperwork. Get the name and badge number of the officer that refused.

Take it to the limit in a polite and civil manner though and make sure to mention that you are only trying to follow the law. Mention that you were told by officer Alvarez that you can not ride a bike in los angeles without a license and you are scared of being ticketed.

Also. I'm going to assume that they will run out of licenses and won't refill. How can we make sure that they don't run out? Is there a city service that will refill their coffers with bike licenses ahead of time....?

Also, I agree on your point about Alvarez, etc. What they did was unneccessary and hostile, so I have no particular sympathy for them. It certainly didn't take four squad cars to give out a few tickets on a Friday night, when I can only imagine what other kinds of shit was going down.

Does anyone want to simply get this rule repealed? Document the hell out of your experiences and start sending them to city council peeps. Blog about it. Make a crappy youtube video. Tell everyone you know and get them to write letters to city council too. The police may be the ones making the process difficult, but city council is the reason the process exists in the first place and they have the ability to repeal it whenever they want.

The little baldheaded cop was being most aggressive with our group. We were riding letter of the law legal (except for 26.01) when he drove in front of our small splinter group at 2nd and broadway the FIRST time and slammed on his brakes to pull us over. Someone had a copy of the cvc (barleye?) thankyou. Because he tried to say we were illegal because we rode on the right and passed all the cars stopped at the light on 2nd and waited for the red in the front. When he pulled us over he very dangerously cut us all off and nearly cause some of us to fall. I wish I could remember his name specifically out of the list of names and badge numbers I got. He let us go because there was nothing he could have gotten us on. When he and his buddies pulled us over the SECOND time, that's when he again drove right into the group and nearly caused an accident. Pulling us all over and then finding a technicality at the behest of Alvarez.

I'm kinda curious why we'd need to show up at the police station for a bike license if bike shops can give them out for new bikes? Couldn't you get the app from a bike shop? Or just print your own? Santa Monica accepts homemade bike license applications through the mail, and the licenses are California State bicycle licenses. If your bike is licensed anywhere in the state then the city of LA can't touch you.

Anyway, the city council would love to hear your thoughts about this rule. Why don't we ask them why LA hates cyclists? I'm sure they don't want us to fundraise and vote for their opponents in the next election.

I'm just not sure what a show of numbers is really going to accomplish. There's a good chance it will just escalate tensions, which is counterproductive. Like them or not, the police aren't going away and they're sorta doing their job when they keep a close eye on the rides. We're much better off being absurdly friendly and courteous, since so much of the law enforcement environment is in their discretion. If they like the ridazz they're far more likely to turn a blind eye to our shenanigans. If they hate us, they're going to keep finding ways to legally screw us. I'd rather we butter them up, even if we don't enjoy it, and take their bosses on the council to task for the stupid rule. Instead of a mob of angry people showing up at their station, why not a mob of happy people bringing them cake? They wouldn't know what to do.

Going over the head of LAPD is critical and a necessary part of the solution. However, even if you try buttering up the law enforcers while you're talking to the law makers (city council)....you still need that license.

What do you do if you run in to Alvarez and his buddies again in downtown??

As long as a "mob" doesn't show up and get unruly, there's nothing wrong with respectful cyclists showing up to get the licenses.

It's kinda like a critical mass at the police station....it helps prove the inefficiencies and inadequacies of the current system that THEY set up.

I think most of it boils down to a power struggle. They're severely outnumbered. Most of the ridazz don't commit any real infractions, but the police are stressed because they're somewhat responsible for 'handling the situation' of hundreds of people on bikes running semi-amok, making noise, causing complaints from motorists, and doing what we do. So they do anything they can to show their bosses and the disgruntled motorists that they have 'laid down the law.'

If everyone has a registered bike, they're just going to find something else as long as they feel like it's an adversarial situation where we are their opponents.

I agree with Roadblock. We won't show up there an angry mob, We are peaceful cyclists only trying to obey the law as Officer Alvarez so dutifully informed us we must do. RB is right, if we go over there, and THEY realize what a PAIN IN THE ASS enforcing that law is, then they'll be less likely to enforce it in the future.

It's like with weed, they got bombarded with kids going to jail cuz they had a little weed, realized it wasn't worth the hassle so now you'll just get a ticket and THATS only if its a dick cop.

Lets bring them treats!!!! I'm being 1 billion percent serious here. On thursday, I am bring down some food or something they would appreciate. List your ideas!!

First. They have to understand that if they harass us for something petty, its going to hurt in a legal process kind of way.

Next, by showing up we are showing that we WANT to be legal. We want to be law abiding citizens.

Third, after my last license, the officer said "sorry about the wait" I said back to him "no problem, you guys have a lot to deal with." I really felt for those guys. The place is in disrepair. If I worked there I would lose my cool too.... lets show them that we care. Lets bring them cookies, or baked cakes.... something that shows that we really are good people. Its like the front page says... "Ridazz salutes the LAPD" and they have been really cool all these years. This is our chance to lobby our LAPD with better treatment and civil obedience.

I bet next time they will turn a blind eye both because we were nice and because we were a hassle.

FOR riders not from LA:

If you license says your residence is in a different city than LA and NOT a city that requires bike licensing, THEY CANNOT TICKET YOU.

I have a cop in my class, asked her and she looked it up for me. It has to do with having a reasonable ability to know you can get ticketed, if you are from a city that does not require licensing, it is not reasonable for you to buy a license to ride your bike through a city that does.

The only cities that have mandatory licensing are Santa Monica, Los Angeles, and Long Beach.

well, I think that society needs good police officers to protect people. if you agree with that then it is possible to feel compassion for these people who are paid to protect us. They are a public agency and if we lived in a fair world then their agency would treat everyone fair. In order to treat people fairly the agency would have to be funded well and staffed well and given the proper tools and training for protecting the population. These guys don't have that. Their station is in disrepair, they are surrounded by homeless and crackheads and they get quite a negative view of the world. no one can work there for long without becoming a negative person in my opinion. So, even though I got a ticket and even though I feel it was harassment, I am still willing to fight the good fight. I'm willing to take my principals of love and good will even to the police. We are all human beings and I believe that society needs referees ie. police and a judicial system to settle beef between it's citizens. So fuck it... lets be the righteous ones and start the love. If they don't accept then there really is no hope.

I spent nearly an hour sitting in an office at the foothill division trying to find out how to get a license tonight. The desk officer sent me to the senior lead officer.

The CLO had no idea what I was talking about...but he spent alot of time looking for forms, checking the vehicle code and calling other divisions....HE WAS DETERMINED to get me an answer to my question.

I told him about a pregnant lady at central division....so he called there.

After some good conversation, he thanked me for informing him about this process, apologized for being unable to help me at his branch, and assured me no cyclist would be ticketed for this infraction in his jurisdiction. He also recommended writing a letter to the chief of police regarding making the process more accessible.

Officer martinez has restored my faith in the LAPD (a little bit)....at least there is one good guy out there.

Such good times at the Skid Row Police Station! Josef showed up with a cake, I rode the wall, Eddie and DaKenzy laid hands on a Police Car, a good time was had by all!

Apparently the renewed commitment to the licensing of bikes comes at the directive of Captain Wall (213-972-1298) and the motivation is unclear. He is still "not in the office" and nobody else seems to want to speak for him.

Oh yeah, like I said before I suspect the motivation for this crackdown has something to do with the large homeless population in Central Precinct. One more "probable cause" or minor violation that they can be rousted for?

The guy taking the license application yesterday was polite and efficient, but he seemed mildly miffed at having to spend so much time doing this petty paperwork as well as a little bewildered as to how & why we all came to be there. He even suggested that PD should consider setting up some sort of bike registration event.

Maybe we should have told him to come out to the start of next month's Midnight Ridazz? ;)

LAPD won't show up for tonight's LA Critical Mass, it would be to costly.

Only SMPD shows up to SMCM, because they have allocated the funds for the monthly ride....so next week, they will be out in force.

The bike license requirement is bogus. Since they don't issue licenses everyday,it isn't available at all locations, and they sometimes don't a cop available to issue the license.

According to Los Angeles Municipal Code 26.01

A. No bicycle shall be sold by a duly authorized agent unless a valid bicycle license or bicycle license renewal indicia has been attached thereto prior to sale or unless a bicycle license or license renewal indicia is sold and issued to the purchaser and attached to the bicycle at the time of sale. Such license or license renewal indicia shall be sold only upon full payment of the required fee set forth in Subsection (g) hereof and no other sum.

for anyone who needs to fight this bs ticketing, I'd take a good look at what the CALIFORNIA bike law says, not the local ones, it states all kinds of stuff, like how it's supposed to be possible to get registered at bike shops and such, and you probably have a pretty good argument in court based on the fact that the system is not implemented a the law states....

ran into Roadblock's group as they were leaving the station ...

process was quick and painless, the gal behind the desk was super nice and friendly, but wondering why there was a surge of bicycle license registrations all of a sudden... I had all my info. ready to go, serial number written down, make, size, etc so filling out the form went smooth.

She mentioned she had a bike that's been sitting in the garage, and I told her about the Oven, and how we can give her a hand if she's interested in getting it rolling again. She almost sounded interested, so who knows...

On my way out, I bumped into another Rida on his way in, and told him to hurry in before she left the desk...

very cool last night, I rolled with 4 people and met up with a bunch at the station. only two of us were actually getting registered. got me thinking, in the case of Joseph and other places like the bike kitchen and so forth that have tons of bikes to register but only one owner, maybe we could organize a helper ride where we all roll the unregistered bikes along with their owner and get them all registered at once so we can kep the flow going on.

Rich (newb310) and I went to get licenses yesterday and they FUCKING RAN OUT OF THEM.

Great. So they're actively ticketing people for an obscure law and they don't have the materials we need to rectify that. AWESOME, YOU MORONS.

The deputy at the front desk (who was FUCKING GORGEOUS, but that's not the point) was nice enough to write Rich and I these little "passes" that stated we attempted to get Bike licenses but they were out of them, so we don't get ticketed.

So yeah. I'm calling Monday morning to see if they have more.

ok, I called over there. 213 972 1880 apparently an officer has yet to go to city hall and buy more licenses (even though it has been a week). I spoke with sgt cheney and he said the officer in charge of the bike licenses will be going to city hall to pick them up today or tomorrow morning and that there will be licenses available by thursday.



If I can build a new roadbike by thursday I will be in line to get my license for it.

So I went to this BAC meeting last night and ranted about Municipal Code 26.01.

I wish I had come up with some clever talking points regarding the licensing program, but unfortunately I didn't have time. 2 minutes for public comment means 2 minutes. Dammit.

Instead I focused on giving them an example of the misuse of 26.01 by explaining our little encounter with Officer Alvarez and the inefficient and limited accessibility to the actual licenses.

Jay Slater from the Mayor's office seemed to take interest in the issue and asked that it be agendized I presume for the next BAC meeting. Even good old Alex Baum commented that police shouldn't be bothering people asking for licenses if they weren't doing anything wrong. I hope it shows up in the minutes because I had a little trouble hearing and understanding him.

All in all it was a learning experience, but I hope it helped in renewing interest in the licensing program since apparently it is an old issue for the committee.

No problem. Luckily the guy that followed me during the public comment added to the discussion and summarized the issue pretty well. Thanks, Mark...if you're out there somewhere.

If it is going to be on the agenda, I hope more people go to the next BAC meeting with some good ideas and plans on how to deal with the mess that is the license program. I would like to be there, but I am going to be in the middle of a huge trial with my boss so I may not be able to make it.

Based on the BAC's discussion, it seems like making any changes to the law or repealing it completely is a big pain in the ass that always gets stalled or is lost somewhere in the various city committees and subcommittees.

I think one good idea, which has all ready been discussed, is following the example of the Santa Monica website which just tells you to mail in the information with your cash. Relatively inexpensive and cuts out the headache for police stations to deal with all the walk-ins. Easy.

I don't think this will stop guys like Alvarez from using 26.01 arbitrarily, but at least he won't have the satisfaction of writing a bunch of tickets if people actually do have the licenses. The cop issue is a lot hairier and complicated. I don't know if the BAC can do much about it.

The best offense is a solid defense?

LA's Bicycle License Law (LAMC 26.01) violates the State's Uniformity Code (CVC 21) and is thereby invalid and unenforcable.

The State authorizes a municipality to require RESIDENTS to ride with bicycle license. (CVC 39002)

CVC 39002. (a) A city or county, which adopts a bicycle licensing ordinance or resolution, may provide in the ordinance or resolution that NO RESIDENT shall operate any bicycle, as specified in the ordinance, on any street, road, highway, or other public property within the jurisdiction of the city or county…

LA's LAMC 26.01 specifies NO PERSON, which exceeds and violates the STATE UNIFORMITY CODE.

LAMC SEC. 26.01. Requirement. NO PERSON shall operate or use a bicycle upon any street or public highway of the City unless such bicycle has been duly licensed as provided herein. For the purposes of this section, the term "bicycle" shall also include "motorized bicycle."

The "no person" part of this city code is inconsistent with CVC 39002 which specifies "no resident", since a city cannot require non-residents to purchase a license, even if they buy a bike in LA, or otherwise cite non-residents for not having a license!

Thus LA Muni-code 26.01 is illegal because it conflicts with the CVC and is therefore unenforceable! All of the citations to non-residents should be thrown out of court, and one could argue that because the law isn't in conformance with the CVC, that any citations issued by the police or code enforcement officials are non-binding because the city is violating CVC 21, which requires code uniformity.

CVC 21. Except as otherwise expressly provided, the provisions of this code are applicable and uniform throughout the State and in all counties and municipalities therein, and no local authority shall enact or enforce any ordinance on the matters covered by this code unless expressly authorized herein.

A group of us were Downtown last night and were discussing bike laws with a cop that was working a film shoot. He claimed that you could get a bike license at any station! Of course, a few of us related our experiences of being told that we had to go to Central Division and he was like "yeah, yeah, they're telling you that because they're not trained to do it, etc, but any station can do it, you just have to insist". Your actual mileage may vary, I suspect.

As far as getting tickets for not having a license, he says that anytime a police officer wants to shut you up or stop you from making trouble, he can find something to write you up for. Big news, eh?

He also told me that it was illegal to ride a bike on the sidewalk in the City of L.A. which contradicts what I thought I knew, but again he claimed he knew what he was talking about and even whipped out his little code book. He says the LAPD just basically ignores enforcement of this law because it's such a low priority.

I asked this guy what station he worked out of and he told me, "Traffic". The more ya talk to cops, the more confused ya get, right?

Congratulations, you found a cop who had no idea what he was talking about.

I talked to the person in charge of the bike licensing program. She's admitted to me that most stations don't give out licenses. Mose don't even have the paper work.

Second, it is completely legal to ride your bike on a sidewalk in LA. There's actually a small movement in the City Council to repeal this right being led by Tom LaBonge. I'm sure the Council would be shocked to learn they're repealing a law that doesn't exist.

1. No person shall ride, operate or use a bicycle, unicycle, skateboard, cart, wagon, wheelchair, rollerskates, or any other device moved exclusively by human power, on a sidewalk, bikeway or boardwalk in a willful or wanton disregard for the safety of persons or property. (Amended by Ord. No. 166,189, Eff. 10/7/90.)


TRANSLATION:
You CAN ride on the sidewalk as long as you are careful (or at least not disregarding other people or property's safety).

It is legal to ride on the sidewalk, but the way Municipal Code 56.15 is written it's kind of vague to most people because it uses legal terms of art. "willfull or wanton disregard" is another way of saying "reckless," which carries a sense of indifference for the consequences of your actions. So if you ride carefully, you can't be disregarding safety.

Moreover, it's easy for our law enforcement friends to misunderstand it because it's written in the negative. If a cop just reads the first four words of the code, yeah he's gonna tell you it's not legal to ride on a sidewalk. If he takes a second to read it all and think about it he'll realize..well...it depends...how fast were you going? were there other pedestrians around? etc.

Thanks for finding that section, DJ. That's the way I've always read it, too. Personally, I almost NEVER ride on the sidewalk and only then with great embarrassment, but I don't like the idea of a police officer telling me I can't do it, especially when it turns out he's misinformed.

It's one of those laws that's open to interpretation and potentially makes it your word against an officer's if they decide to say you were riding "recklessly". Then again, I also speak as a pedestrian that has almost been run down on the sidewalk by cyclists more than once. Oh, the irony . . .

LA's Bicycle License Law (LAMC 26.01) violates the State's Uniformity Code (CVC 21) and is thereby invalid and unenforcable.


Summary of the express authority to regulate bicycling:

CVC section summaries:

1. Section 21: “Except as otherwise expressly provided, the provisions of this code are applicable and uniform throughout the State and in all counties and municipalities therein, and no local authority shall enact or enforce any ordinance on the matters covered by this code unless expressly authorized herein.”

2. Section 21100(h) Expressly authorizes local authorities to regulate the use of bicycles on public sidewalks.

3. Section 21206 Expressly authorizes local agencies to regulate the registration, and the parking and operation of bicycles on pedestrian or bicycle facilities provided the regulation is not in conflict with the CVC.

4. Section 21960 Expressly authorizes local agency prohibition of bicycling or walking on freeways.

5. Section 39002 Expressly permits a city or county to adopt a bicycle licensing ordinance or resolution providing that no resident shall operate any bicycle on any street, road, highway, or other public property within the city of county, unless such bicycle is licensed in accordance with this division.

7. Supportive legal opinion & appellate court ruling:

a. Attorney General’s opinion: 52 Ops.Cal.Atty.Gen. 313, 314 (1970) cited Wilton v. Henkin (1942), 52 Cal.App2nd 368, 372 which affirmed the superiotiy of state legislation for traffic regulation over local ordinances.

Since the City of LA's LAMC SEC. 26.01. specifies that no PERSON shall operate or use a bicycle upon any street or public highway of the City unless such bicycle has been duly licensed..." it exceeds the express authority as specified in CVC 21.

Los Angeles exceeds its authority under State law, LAMC 26.01 is invalid, the LAPD are left with no statute or municipal code requiring a bicycle license.

The ticket is written with no legal authority. It's invalid.

Thank the Judge and ask him to join you on the Judgement Ride!

Understanding about the bicycle license thing in L.A. that was pulled in Jan….. I still wanted to see if I can get my bike registered w/ the City of Glendale. So I call Glendale PD (they no longer handle that) ~~~> sent to Glendale Fire (they don’t do it anymore and told me to call City Clerks office.) I call and after being on hold for 10 min… the girl tells me to contact a Sgt. Lowery w/ the traffic division. I called and Lowery is retired and the lady tells me to try Traffic and Transportation. I got an endless, looping recording and just hung up. I gave up on Glendale and started calling LAPD and the good thing is that of the three divisions i called.... they all know of the hold of the bicycle program. So that’s a good thing I guess…
